Terms and Conditions

1.    This Promotion is open to residents of Australia (excluding residents of ACT) aged 18 or over, excluding employees of the Promoter, its agents and anyone professionally associated with this Promotion. 

2.    No purchase necessary; however, internet access, email address and a valid Instagram account are required.  

3.    Promotion Period: Enter between 10:00am ACDT on the 02 February 2025 and 23:59 ACDT on the 9 February 2025 inclusive.

4.    To Enter: Log onto your Instagram account (or create one for free), then follow either Golf Gods or Golfslump, and Torque GC, click the link in the Instagram Promotional Post and complete the online form with your details (full name and email address) to be entered into the Sweepstake.

5.    Maximum of 1 entry is permitted per person during the Promotion Period. No person may win more than 1 Prize.

6.    The Prizes: There will be a total of 8 winners. The Prizes are as follows and will be randomly allocated:
a.    1 of 3 x pairs of Shark Shack 1-day tickets to LIV Golf Adelaide 2025 for the winner and a guest at the Grange Golf Club, Adelaide valued at AU$649.43 each;
b.    1 of 5 x pairs of 1-day Grounds Passes for the winner and a guest to LIV Golf Adelaide 2025 at the Grange Golf Club, Adelaide valued at AU$81.00 each.
The LIV Golf Adelaide Event takes place on 14 February 2025 – 16 February 2025. Exact ticket dates are subject to availability and the Promoter’s discretion.

b.    The Promoter cannot guarantee a specific day for the Prizes to be taken and will be subject to availability and at the sole discretion of the Promoter.

d.    Shark Shack Tickets: Each ticket gives you:
1.    A vibrant open-air section with an electric atmosphere.
2.    The chance to hear the player walk-ons and banter with the on-course announcer.
3.    3 drinks per ticket (beer, wine, and soft drinks).
4.    *Children aged 4 and up are required to hold a hospitality ticket for entry. Grounds access is included in all hospitality tickets.
5.    **As part of any ticket you can experience all that the Fan Village has to offer, as well as general access to any post-round concerts on the day you attend.
e.    Each Grounds Pass ticket: Each ticket allows the following access:
1.    The opportunity to get right to the front and cheer on your team.
2.    The freedom to explore every single hole.
3.    Access to the Watering Hole, the loudest hole on the course (first come, first served).
4.    Access to Fan Village and any post-round concerts on the day you attend.
5.    Free Grounds Pass admission for children aged 12 and under with a ticketed adult at the entry gate. A paid adult ticket needs to accompany one youth ticket.
f.    For the avoidance of doubt, the Prize does not include travel/transportation, accommodation, food, beverages, souvenirs, gratuities, car parking charges, excess baggage, additional excursions and attractions or any other costs of a personal nature (including spending money) that are not explicitly set out in these Terms and Conditions and neither the Promoter nor any provider of any part of the Prize will be responsible for any such costs. For the avoidance of doubt, dinner at a hotel will not be included. 
g.    The Winner is responsible for the behaviour of themselves and their guest whilst taking the Prize. The Promoter reserves the right in its absolute discretion to exclude a winner and/or their guest from participation in any aspect of the Prize if any party fails to comply with the directions of the Promoter or any companies associated with the Prize or if a winner and/or their guests act in a manner that is dangerous to themselves or to the public or is, in the opinion of the Promoter, anti-social in any manner or which causes a disturbance or nuisance to others. Failure to comply with these Terms and Conditions may result in refused entry, or the ticket holders being required to leave the event/venue.
h.    If for any reason the event is not capable of running as planned, such as cancellation or any other cause beyond the control of the Promoter which affects the running or conduct of this promotion, the Promoter may in its sole discretion cancel the Prize and not re-award any additional tickets to the winner or reimburse any incurred expenses by the winner as a result of winning or accepting the Prize.
i.    Once tickets have been issued, the Promoter, will not be liable for any failure to comply with its obligations caused by (but not limited to) weather conditions, fire, flood, strike, hurricane, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, illness of a performer or any other circumstances beyond the control of the Promoter.
j.    The venue reserves the right to refuse entry to any person who does not adhere to their terms, checks and requirements, regardless of possession of a valid ticket.
k.    Winners must inform the Promoter of any wheelchair or any similar access needs.

8.    Winner Selection: 8 provisional winners will be randomly selected from all valid entries received during the Promotion Period. For your total confidence, the Prize draw will be conducted by LIV Golf at LIV Golf, Level 4, 30 Stamford Street, Southbank Central, London, SE1 9LQ, at 15:00pm GMT on the 10 February 2025 / 01:30am ACDT on the 11 February 2025. 

9.    Unclaimed Prize Draw: If any Prize Draw Prizes are unclaimed 3 days after the close of the Promotion Period, an unclaimed Prize Draw will take place from all non-winning valid entries 13 February 2025 at 15:00pm GMT / 14 February 2025 at 01:30am ACDT by LIV Golf at LIV Golf, Level 4, 30 Stamford Street, Southbank Central, London, SE1 9LQ. Provisional winners of any unclaimed Prizes will be notified via the email address provided on entry within 1 working day of Winner Selection and will be subject to the Winner Notification and Prize Acceptance terms outlined in clauses 10 and 11 respectively. 

10.    Winner Notification: Provisional winners will be contacted via the email address provided on entry within 24 hours and will be asked to provide evidence of identity and eligibility. Reasonable efforts will be made to contact the provisional winners. Once eligibility has been confirmed, the provisional winner will be confirmed as a winner. If a provisional winner does not respond to the initial contact within 48 hours, we reserve the right to disqualify that entrant and award the Prize to a reserve selected in the same manner. Reserve winners may have less time to respond. 

11.    Prize Acceptance: Fulfilment of the Prize will take place within 3 days of acceptance of the Prize. In the unlikely event that the Prize or part of the Prizes does not arrive within 3 days the winner must inform the Promoter by emailing Andres.ruales@torquegc.com within a further 2 days. If a winner does not do so, the Promoter reserves the right to not reissue the Prize at its sole discretion.

12.    Provided no objection is received from the winners, a winners list containing the first initial, surname and postcode of the winners will be made available by the Promoter 4 weeks after the close of the Promotion Period, for a period of 8 weeks. It will be available by sending a request via email to Andres.ruales@torquegc.com. Winners can object to their details being during the Winner Notification process. Without prejudice, the Promoter will provide winner information to the Australian Authorities when requested by them.

13.    The Promoter may request that the winners participate in publicity arising from the Promotion. Participation is at the winner’s discretion and is not a condition of Prize Acceptance.

14.    The Promoter seeks to run a fair and secure promotion and prevent abuse and cheating. If you enter in a way that is not consistent with these Terms & Conditions, your entry (and any of your associated aliases) will be disqualified. Any Prize awarded may be void and recoverable, and the Promoter reserves the right to bar you from entering future promotions for a period of at least six months. For this reason, the Promoter reserves the right at any point to:

a.    Verify the eligibility of entrants and/or provisional winners through multiple means by requesting such information it consider reasonably necessary for this purpose. Entry or a Prize may be withheld until verification is completed.

b.    Disqualify entries that are not made directly by the individual entering the Promotion. 

c.    Disqualify entries made using anonymous email services such as, but not limited to, GuerillaMail, Dispostable or Mailinator.

d.    Disqualify bulk entries from individuals, trade, consumer groups or third parties, incomplete entries and entries submitted by macros or other automated means.

e.    Disqualify entries beyond the maximum allowed, or those using techniques such as ‘script’, ‘brute force’, masking identity by manipulating IP addresses, using aliases or identities other than their own or any other means.

f.    Disqualify entrants who tamper with the entry process.

g.    Disqualify entries which, in some other way, do not meet the requirements of these Terms & Conditions. 

h.    Cancel, modify or suspend the Promotion should it not be capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, dishonesty, technical failures, or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion.

15.    The Prizes are not transferable or exchangeable and cannot be redeemed for monetary value or for any other form of compensation. If for any reason the Prize or any element of the Prize is not available, the Promoter reserves the right, at its sole discretion to substitute that Prize or element of the Prize for another of equal or greater value.

16.    No responsibility can be taken for entries which are lost, delayed, corrupted, damaged, misdirected or incomplete or which cannot be delivered for any technical, delivery or other reason. Proof of sending will not be accepted as proof of receipt. The Promoter does not guarantee continuous or secure access to Instagram or the entry page.

17.    This Promotion is in no way sponsored, endorsed or administered by, or associated with Instagram. By entering you are providing your information to the Promoter and not to Instagram, and Instagram is not responsible for any element of this Promotion.

18.    The Promoter and its associated agencies and companies are not liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion (JS15439) or accepting or using the/a Prize(s), except for any liability which cannot be excluded by law.  Nothing will exclude the Promotor’s liability for death or personal injury as a result of its negligence.

19.    The Promoter will not be liable for any delay or failure to comply with its obligations for reasons beyond its reasonable control arising from but not limited to Acts of God, global or regional epidemic or pandemic, adverse weather conditions, fire, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, plague or other natural calamities, or any other circumstances.

20.    All personal data supplied for this Promotion will be used for the purpose of this Promotion and for research and analytical purposes by the Promoter and/or by any agent appointed by it to assist with running the Promotion. Personal data will not be disclosed to an unconnected third party unless your positive consent has been obtained. Your personal data will be handled in accordance with the Promoter’s privacy policy, available at: www.livgolf.com/privacypolicy. 

21.    If any part/s of these Terms & Conditions are legally ruled to be invalid, illegal or unenforceable, the remainder will not be affected and will continue in full force and effect.

22.    By entering, you will be deemed to have agreed to be bound by these Terms & Conditions.

23.    If there is a discrepancy between these Terms & Conditions and those in any promotional material, these Terms & Conditions will prevail. 

24.    These Terms & Conditions are governed by Australian law and their interpretation and application will be subject to the exclusive jurisdiction of the courts of Australia.
